chpt 13 - can't get rid of cars


What is the name of your state? Louisiana

I have filed chapter 13 and have forfitted 2 cars. The finance company will not come get the cars and I have offered to have them brought to them and hand them the keys. They will not accept the cars. Is there anything I can do to make them take the cars. They are sitting in my drive and I can not use them and they are taking up space that I need. I have turned in the tags and canceled insurance. Also if they will not take them is there anything I can do to get rid of them?

try send ing them a letter certified that if they dont get the cars by a certain date then you will start charging them storage fees of $25 per day per car. explain to them that because of the BK they are the legal owners of them and they need to come get them. you could also just park them in a no parking zone where they will be towed away

Give them 10 days in your letter, then call the police to tow.

Or... if they bank has a branch in your area.. tow them to the branch parking lot and leave them there - its their property.. and their problem.

I like the $25 per day storage fee. Be sure to let them know in your letter that you will not be held responsible for any damage done to their vehicles and that by leaving them at your house they are accepting any and all risks... same kin dof thing as is on the back of a parking slip.

Has the Bank/Lending Company given a reason as to why they will no take possesion of the vehicles?

They don't think the cars are worth the cost of recovery - That is the only reason I can figure - when I call and talk to them I usually get hung up on without any responce - when I offered to bring them to them and hand them the keys they told me that my attorney and trustee had to work the return out and the finance company could not do anything about it. The cars are not in real bad shape although after sitting for 4 months they don't crank anymore. I feel that if they had taken possession when they should there would be no problem with the cars now.
