Collection after discharge 10 years agoI filed Chapter 7 in 1991 and was discharged of debts on 7/10/1991. American Express was listed on my discharge. In 2001 I received a sort of collection letter from Plaza Associates on behalf of American Express giving me an "opportunity to regain cardmembership". First, Is this legal? If I recall my lawyer's warnings at the time I filed, he did indicate that creditors could retain information on my bankruptcy as long as they like to but they could no longer report the bad debt to the credit agencies. (They can hold a gudge as long as they want to.) Now for my delema. Our company uses AMEX for travel expenses. I was declined a corporate card last year and I am guessing it's because of my backruptcy and AMEX having a long memory. I'm thinking this collection letter is just they're way of saying we'll give you the corporate card, but you've got to pay us the money you owed us. Any constructive thoughts on this are welcomed. I'm considering contacting AMEX regarding this issues, but I thought I'd seek a little free advise first! Thank you. Steve |

| Does the letter say that they'll give you a card if you pay them money? Or are they just giving you an "opportunity" to have a card with them again? I'm unclear on that. Obviously, if they were listed as a creditor and your debt was discharged, then you owe them nothing. |

| I appologize, I forgot to mention this was filed in CT. So legally they can't collect the debt. That's what I thought. Can they deny me credit based on the fact that I had a debt with them that was discharged? The letter does say "opportunity". My credit rating is excellent, so that's not an issue. And frankly I wouldn't care except I need AMEX for business travel or the expense reimbursement is a real bitch. Is it worth writing a letter, explaining the situation and see what they say? | They sure can deny credit based on a discharged bk. Some cc companies keep a "black list". I've heard different stories about whether AMEX does or not. I guess it wouldn't hurt to ask but, I'd do it through AMEX and not a collection agency. |
