Condo Fees


I live in Phila. Pa. If I file for bankruptcy,can I include my past due condo fees? I guess what I'm asking is will I have to pay those fees or will they be treated like my credit card debt?

I cannot think of any reason that would prohibit you from including your past-due condo association fees in your dischargeable debts in a bankruptcy.

If you are really late they are probably getting ready to put a lien on your home.
If you somehow manage to discharge that debt you are going to have a very angry bunch of neighbors. They may also have the right to suspend your privileges in common property. If they do lien the condo they will eventually foreclose. Try to scrape up the money and pay the HOA dues.

I think that suspending the condo owner's membership or rights could be a violation of the Federal bankruptcy laws.

However, I do agree that not paying the debts or having them discharged would be viewed as a negative by the neighbors. Condo owners can get real nasty...especially the ones who don't understand the law.
