Continuation of Rude collection call

What is the name of your state? Tennessee
Sorry about that, I ran out of room. I am disputing a child daycare debt that the daycare said I owe for 2 weeks of service that my daughter was not even there. I am not paying for the daycare when I told them she would not be back and there is nothing in the contract that said that I have to pay, only that I let them know when I plan to take her out. I do realize that daycare charge whether you take them or not to hold your spot but this was not the case. I did not leave owing a balance and the letter that she sent me said due to lack of attendance that my daughter would be dropped from daycare. She turned it over to collection when I refuse to pay and then the amount doubled. The only way that she could say that I owe if my daughter was in her care and I left not paying a balance owed. I have contacted several daycare centers and they all have told me the same thing. I think this lady is just trying to get money out of me that I don't have. I pay my bills and I am not a deadbeat but I am not stupid and I will not pay for something that I didn't get service for. The gentlemen at the collection agency was very provoking and picked at me to make me angry. I realize that I should not have lost my temper but I don't think anyone would like being called a bold face liar. I even tried talking to his supervisor and she was just as bad. She said that she will do her job and if I refuse to pay then a civil warrant would be issued on me and that she did not appreciate the way I talked to her employee. I told her that she needed to get new employees if they were going to degrade and provoke customers and she said that she was there the whole time he was talking to me and she didn't hear him say anything wrong, all she heard was me yelling at him. Mind you he had to go find the supervisor when I asked to speak to her. I tried to talk to her but she got real smart and huffy and then she started in about the legalities I will face. I just had enough and told them do what they had to do but I was still disputing the debt. Do I not have the right to dispute the debt. I thought you had 30 days to notify them of the dispute. I could really use some help on this matter because I have never been talked to like that from anybody. Not even my family.

little miss...i am so sorry that you have such a bad experience. i want to tell u a little something. i work for a major finance company and am a bankruptcy specialist, my job is actually 3 or 4 jobs...i am an account manager, a paralegal, an underwriter and a collection person within the bankruptcy department. this is what's going on. normally at the beginning of the month the collector gets a list of accounts that MUST be collected, the collector has to fill a quota if he doesn't do this then he is out the door. i have never, ever, ever talked to any of my customers in a degrading manner, as a matter of fact i have received letters thanking me and some tell me they feel like they are talking to a friend when we talk on the phone, i never keep it business only and am interested in what they have to say. i have one client in new york whom i call once in a while to see how the wife is doing because she's been terribly sick and i call just to call and say hi. anyway, yesterday near the end of the day i was taking care of some paperwork and overheard a colleague of mine who has been described by customers as rude and harsh and threatening. he talked to a client in a manner that made my hair stand up straight, he was demeaning and insulting, if anyone were to talk to me this way he wouldn't be on the phone for longer than 15 seconds with me. collectors have absolutely no moral rights to disrespect anyone, we do not know how a customer came into the dilemma he is in and it's just a matter of respecting one another. after i heard that call, i grabbed my cigarettes , left my desk went to see my co-worker and told her, i can't do this anymore. i told her about what i heard and said, i need to get the heck out of here, it is horrible how some collectors address their customers to meet a quota or for any reason at all. little miss, my suggestion is to get call intercept or privacy manager, don't answer the collection calls and throw the threatening letters in the trash, forget about them. they can't take a house from you, they have no lien on anything, it's an unsecured debt they have no leg to stand on. do u have any cancelled checks that show that you have made your payments and anything else that proves that you are not obligated to pay their debt ? get it together, make copies, keep ur originals and submit them to the daycare or whomever you have to submit them to, to stop this nonsense, other then that ur best bet is like i said get call intercept etc...or if u pick up the phone and you hear ..may i talk to mrs so and so....ask who is calling and if they are collectors, hang up. take care.

Do you have your original paperwork where you put the child in daycare. I am in Tennesse and everyone that I know of and have contacted has a clause that states you must give a two week notice. If you just pulled her out then you would still be responsible for those two weeks unless she was only signed up for a limited time.
