Converting Chap 13 to Chap 7What is the name of your state?Ga I am presently in a Chapter 13. I am wondering what qualifies me to keep or reaffirm the secured debt of a mortgage and automobile if I converted to a Chapter 7. I was wanting to refi my home and payoff the current BK but since I am under 36 months into the plan, I would have to go back and pay 100% on the debts, which would not be feasible. So I was wondering if I could convert to a 7, but keep my house and auto. Then I could make some things happen. |

| Why did you file a chapter 13 to begin with? Either you had too much disposable income for a 7 or, you had too much equity in your home or auto. Do those conditions still apply? |

Chapter 13 Conversion?At the time of filing, my mortgages balances were 59K and 39K with a house value of 120K. How much disposable income can you have? How much equity in your home can you have? Thanks |

| Here are Ga.'s exemptions. [url]http://www.thebankruptcysite.com/bankruptcy-exemptions/georgia.php[/url] Just a real general rule, much over $100/month will get your Chapter 7 dismissed. Talk with your lawyer about the possibility of conversion. |
