Converting to Chapter 7 bankruptcy


What is the name of your state (only U.S. law)?
Mississippi

In 2007 me and my husband filed Chapter 13. We were able to make regular payments under the plan, but lately we have not been able to meet the payment demands. We both lost our jobs this year. The total amount that we pay each month is $1918.00. Our total income is currently $2256.00. That only leaves us with $338.00 to pay for utitlities and food. The total members in our household is 4.
Right now, I am only concerned about keeping my home. Is there any way that I can convert to Chapter 7 without losing my home.

I almost feel that my only way out is to give it all up and start over. Due to the fact that a lot of rental offices use credit reporting agencies to consider applicants for housing. I worry though that finding another place to live may be impossible considering that we have filed for bankruptcy and was unable to pay.

Why did you file a 13 to begin with?
Are you current on your mortgage and, is the equity in your home below what your state exempts?
