court summonsWhat is the name of your state? IL I am filing chapter 7 on Oct 3rd, Pro Se. I just was served a summons from Bank One on a vehicle that was repossessed in June. I am to go to court on Oct 16th on this. When i file , do I still go to court or will this put a stay on this creditor? |

| when you file i'd send a copy of bankruptcy petition to the creditor, their lawyer, and the court the lawsuit is in. |

| You should have some time to file your answer - usually around 30 days, though some states its less. At this point in time, unless they're only giving you 10 days to Answer, I would hold off on the Answer to their Complaint, get your case filed, then send your BK case information to the lawyer for the Plaintiff and a copy of your case info to the court as your Answer to the complaint. The latter may not be necessary once the lawyer knows you've filed -there's not a damn thing they can do at that point. Use your time strategically ![]()
