| A credit card company filed a suit against me when the account was not in arrears. The account was $278 in arrears. $500.00 was paid on the account on 9-7-97. The suit was filed on 10-27-97. I answered in thirty days in writing to the lawsuit. I never rec'd any response. In april of 2000 I applied for a auto laon. I was denied because the account was listed as an unpaid charge-off. Later in april I rec'd another letter saying that I was to answer the suit(regular mail) as to whether or not the amount was disputed. Again I asnwered in writing. No response again. What are my options for resolving this matter? Does it matter that the suit was filed while my account was current? I have rec'd no statement on this account since 1997. Thank You |

| Boy, sounds crazy as it appears you are doing all the right things. As far as the law suit, a creditor could possibly sue if there was some type of clause in your credit card contract that says they can declare the entire amount due. But usually they just want their money -- not a judgment.
