Creditors


I filed chapter 7 bankruptcy in Indiana. One creditor continues to call and hassel me. This debt was discharged with the bankruptcy. What can I do?? I've asked to speak to their supervisor when they call but they refuse. I currently record thier calls and have told them I am doing this.

They are in violation of the Federal Bk law. Contact your lawyer or, the bk trustee that handled your case.

That is correct. The continued harassment is a violation of the law -- and plain flat stupid to boot.

I believe that if you have an attorney call the creditor on your behalf, warning that if the harassment continues that you will pursue legal action, that the calls will stop pronto.

Send 'em a letter via certified, return receipt mail. The letter should say something like this:

>>I am writing concerning the account with XXXXXXXXX that your office has repeatedley attempted to collect on from me.

As I have told your collection agents on countless occasions, that debt was included in my chapter 7 bankruptcy filing. The case was discharged on xx-xx-xx, in the xxxxxx district of Indiana, and the case number is xx-xxxxxx.

I will view any further attempts to collect this debt on your part as an intentional violation of the Federal bankruptcy laws. <<<

Try to include a photocopy of one of their collection letter, if you've received one.

If that doesn't stop them, then contact an attorney.
