death of spouse

as a surviving spouse,am I responsible for debts that are in my husbands name only, such as car, credit card?
I assume that I am responsible for home mortgage which is in both names.

My response:

If the debts were incurred during your marriage, then yes. If they were incurred before marriage, then the creditors can file their claims with the court against the Estate. As to joint debts, yes also.
