| would like to try this one more time. I have a credit card debt at least 3 yrs. old. how long is the statute of limitations on credit card debts in ohio? debt collector call and tells me he is an attorney, later find out he is not. tells me i must send $500 in 2 days and $100 per month to keep this out of court. I am a working mom with 3 kids and can't afford this kind of payments. can I send smaller amounts without the consent of the collector and still keep this out of court as long as i continue to make payments.I am desperate for info and at this point can't afford an attorney. someone please help!!!!!!!!!! |

The creditor/collector can bring a lawsuit for the entire amount at any time within that period. If you can prove that the collector held himself out as an attorney, when in fact he isn't, then you may sue him and the agency under the Fair Debt Collection Practices Act. I suggest that you type that into your browser and run a search for the Act, and then read it in full so that you know how to act on your rights in this, and other, debt situations.
