| Debts that cannot be discharged in bankruptcy? What is the name of your state (only U.S. law)? VT
I know that taxes and student loans cannot be discharged in Bankruptcy. However, I did want to know if state fines can be discharged. Basically 12 years ago, my wife and her ex-husband were accused by the DMV for an insurance lapse which my wife vehmently denies. I don't know the actual circumstances but my wife is concerned that she will not be able to prove that her insurance did not in fact lapse**************......unless insurance companies keep records that old. We have only been prompted to find out what we can do because the DMV never pursued her until a letter from them ended up in our mail box the other day after 12 years.So I made the suggestion that we add this fine which is ($5000) to our chapter 7 bankruptcy which we are filing without a lawyer as we simply can't afford one. Am I wasting my time doing this or is it worth a try. If there is a chance it could be discharged would it go on Schedule F or Schedule E. Thanks for any advice in this matter. |
