Disabled and Unable to Pay - Help Please


What is the name of your state? Florida

Due to overwhelming medical bills I have run up quite a bit of credit card debt to several companies. My wife and I are disabled and receive Social Security and I receive a disability pension from the VA. We have a joint checking account. My wife purchased our house before we were married and it is in her name. The debt is in my name and it has been six months since I have been able to make a payment.

Because of my wife’s medical condition we have to travel several hundred miles and spend several days each month seeing a specialist. My son has loaned us his RV to travel and stay in. We are from different states and the RV is registered in his state, but our names are the same except he is a Junior, which is not indicated on the RV title.

The credit card companies tell me they are about to write off the accounts. What does this mean? Will they hire a collection company to try and recover the money I owe? Can they take my son’s RV? Is out joint checking account safe? I have no assets other than a small, 30 year old aluminum boat. What should I expect from the credit card companies or collection agencies?

Writeoff or chargeoff, same thing. It's an accounting term that just says they no longer believe they can collect this debt. Yes, they will then turn it over to collection agencies.

Your retirement and disability income is exempt from creditr seizure. Tey can't touch your son's property. Were I you, I think you and your wife should have separate bank accounts.

Worse caee, they could sue you but, since you own nothing and, your income is exempt from seizure, the judgement will be empty. If the harrassment gets to be too much, you can always file for bk.

I appreciate the advice. I will set up seperate checking accounts.

I am scheduled for bypass surgery July 2. Can I request the collection agencies stop pestering me until I recover?

Absolutely!! Send them a Cease & Desist letter {CRRR} and tell them to not contact you about this matter over the telephone. The only communication you will accept is through the mail. Good luck with the surgery.

You can send them a cease and desist letter and make them stop calling you altogether, restrict them to mail only. That's about the only effective thing. You can ask on the phone, but it won't get you anywhere.
