Discharge Tied to Debt or Debtor?What is the name of your state? CO Hello - When a debt is discharged under a BK 7 or 13, is the debt completely discharged for all involved parties or is the discharge only relative to the debtor who filed? (i.e. more than one unrelated party could potentially be liable for the debt) Furthermore, could the collection of this debt be legally pursued by a collection agency against the second party who did not file bankruptcy? | If you're asking about a cosigner on the debt and he/she didn't file bk-creditors may continue to collect against the non filing party. In a Chapter 13, if the debt is repaid at 100% the bk stay will prevent creditors from pursuing the non filer. |
