Discharged CC Debt listed as Charge Off on Credit Report


New Jersey

My Bk was discharged 2 years ago. 2 credit card accounts with MBNA were included in the Bk**************clearly listed on the Sched. F. The accounts were open when I filed.

Both now show as Charge Off on all 3 credit reports with no reference to being included in Bk. I've disputed it with all 3 agencies twice with no change.

As I understand it, this hurts my credit score.

What can I do now.....what are my rights?

Charge Off debt


You have a right to an accurate credit report. Sometimes mistakes happen, so to make sure both sides are heard, the credit reporting agencies must accept a letter of correction from you regarding the information in your file.

Copy the page in your schedule F showing the accounts listed, copy the misinformation in your credit file, write a letter explaining why this is a mistake. The credit reporting company is obligated to show this information every time they do a report.

Then go back to your bankruptcy attorney and double check that everything was done correctly. There may be some misinformation in your discharge papers that can be corrected by the attorney or your previous trustee. You can also call your trustee's clerk and tell her the problem you're having. The trustee is there to help you. Good luck.
