dispositon of automobile 2 years later? What is the name of your state? CA
My Chapter 7 bankruptcy was discharged in August of 2002. Included in the bankruptcy was an auto loan with Ford Credit that had a balance of about $3,200. At the time, the value of the car was about $2,000. I did not reaffirm the debt and fully expected the car to be repossessed.
I had made several attempts to contact Ford Credit but was told at the time of my Ch 7 filing that the account had been forwarded to an attorney in my home county, at that I should expect to hear from the attorney regarding the disposition of the car. I never heard anything else from the attorney or Ford Credit.
Now, over two years later, I still have this car in my possesion. I have again contacted Ford Credit to discuss the disposition of the car and they gave me the name and number of the attorney handling this account. I spoke with the attorney, who informed me that my account had been closed (discharged in BK) and that he did not know what the disposition of the auto was.
I told him that I still had the car and that I wanted to return it to Ford Credit. The attorney told me that Ford Credit does not want the car. So I then asked what did I need to do to get the title from Ford and he told me that I need to pay the balance of $3,200. to get the title from Ford Credit. This car is now worth about $1,100.
Ford Credit doesn't want the car, and I don't want the car, but I can't sell it without a title. I do have a interested buyer who is willing to pay me $1,000 without the title. What are my rights and responsibilities regarding this car?
Also, one of the credit reporting agencies shows this account closed with a $0 balance, but the other two agencies still show a balance of $3,200 on this account. The last reparting date for all three agencies is 10/2001.
