I filed chapter 7 almost 7 years ago during a previous marriage. My husband needs to file bk desperately. We have been trying to pay off all his debts but are very overwhelmed! Can he file chptr 7 even though my bk is still on my credit report? Can he claim myself and our children as dependents and can he claim our unborn child.????????? Please help!?!?!?!? ( Oregon )

Yes, he can file his own Ch. 7 because everyone has there own credit report.

Yes, if there is need to claim dependants he can claim children. I don't really think he can claim you or an unborn child.

I highly recommend he consult an attorney in your area.
