| Employer filing BK I have just found out that the company I work for here in CA may be filing for chapter 7. I have worked here 10 years and have approx $35,000 owed to me in commissions. One of the creditors my company owes money to just won a judgement and as a result, the company banking accounts have been frozen. The company is incorporated, but my boss signed a personal guarantee to this particular creditor about 8 years ago and so they also siezed his personal accounts and his wife's accounts also citing it as community property. Can anyone advise me as to what my rights are? Someone told me that when this happens, the employees get first crack at any funds, but how can this be if the accounts are all frozen? Our paychecks for the last 2 months have always been a couple of days late, and now I'm wondering what will happen next pay day since the accounts are frozen. I asked the owner of the company for an explanation as to what is really going on and he said not to worry that his lawyer is handling the situation. When pressed further, he said we would all be paid and no one will loose their jobs. I don't know what to think. If I jump ship now, will I loose my commissions and vacation time owed?
