estimated proof of claim


What is the name of your state? FL


I'm supposed to fill out a proof of claim for an "estimated" claim because we don't really know the value of the claim because it hasn't been "liquidated" by a judgement. So I got the form, but theres really not anywhere on there to show that. There's secured and unsecured and priority, but nothing for estimated.

I'm estimating because I dont have an order or anything yet, and since there is no judgement on anything I dont know what kind of supporting documents to put, besides writing some kind of paragraph explaining my situation. Seems like a simple form, but not really, I guess.

Any suggestions?

Where it says "Basis for Claim", check the "Other" box and write in "see attached memo". Then attach a separate sheet that summarizes your claim. E.g., "Unliquidated claim for breach of contract. Creditor alleges that Debtor is, in general, a black-hearted rogue who did him out of $3 million dollars, besides which he's ugly and his mother dresses him funny. Without in any way limiting the amount of any judgment that Creditor may seek or obtain, Creditor presently estimates the value of this claim at $XXX."

You'll (obviously) edit this a bit.
