File 13 after discharged 7


What is the name of your state? Arkansas

I will be discharged in December for all debts except IRS taxes. The finance company who has my equipment (self employed], will not agree to let me reaffirm. They filed Motion For Relief From Stay this week. I was told to immediately file 13 after discharge for 1. Payment plan with IRS taxes to stop penalties and interest and 2. Include my equipment finance company to protect equipment. I need the equipment to make an income. Without income, trustee will not approve 13 plan. Any suggestions? Attorney says this is feasable. Won't trustee say this is abuse? If granted Relief From Stay, can they still be included in the 13? Also how soon after 7 discharge can I file the 13?

you can file a 13 the very next day after your 7 is discharged.

Thanks anadude. I'll keep checking back in hopes that someone can answer some of my other questions!
