Filed 13-Can Spouse Now File 7?

What is the name of your state? New York

A friend filed for chapter 13, and began making payments 18 months ago on a 3-year program. His wife was not included in the chapter 13. Can SHE now file for chapter 7? All of the debt in question is in her name, and none of it (obviously) was included in the chapter 13.

If she can file, does she need to use her spouse's income? She does not work. They have separated, but not legally (yet) Does that have any bearing?
