Filing Chapter 7 but before case closes I will have move out of state


What is the name of your state? VT

Hi I am about to file a chapter 7 bankruptcy without the use of a lawyer**************......yes that's dumb but I don't have the money to pay a lawyer. Anyway, there is a chance my house will sell via a short sale and will close in a couple of months. If this happens my family and I are planning to move to North Carolina where there is no federal exemptions. If I file before we leave the state of Vermont where I can use Federal exemptions, will my case be transferred to North Carolina or will I be allowed to finish the case in Vermont? The federal exemptions are better for me than both the state exemptions of Vermont and North Carolina.

You can move, but you WILL have to be at the 341 meeting, in VT, IN PERSON. When you move, you will also have to notify the Trustee of your new address so that s/he can reach you if necessary and the court has a place to mail any papers.

Would the op also have to notify Trustee of his new situation since it probably would not be same as when he filed? Expenses, Etc.?

Generally speaking, the bk filing is the snapshot of the debtors finances at that particu;ar moment and that's all the trustee is interested in.
The trustee has the right to quiz you about anything they please but, let them initiate any inquiry. Don't volunteer any information.
