Question

filing for an extension for taxes during a chapter 13 bankruptcy


What is the name of your state? virginia
Hi, thanks for this forum. I was wondering if you could file for an extension of your taxes if your in a chapter 13 bankruptcy. The federal and state taxes are both listed as creditors in the 13. However, I would like to file for an extension. Can I do this? If I do, would it put the 13 in harm's way? Could the IRS or State Tax office go the the trustee and ask for a relief from stay or something else if I did this? Or am I like any other person would like to file for an extension? Thanks so much in advance for your answer. Oh yeah, all my payments to the trustee have been on time. If that makes a difference.

Your tax debt for year 2003 taxes is a new, post-petition debt, most likely, and will be treated the same as all other filers. Being in bankruptcy does not prevent you from filing the automatic extension form and should have no effect on your chapter 13.

Thanks, it was a difficult year last year. I havent found anyone suitable yet to help me with my taxes. Or lets put it this way, one I can afford. I will need to save some more money for this. In dealing with my Chapter 13 and financial matters I have learned you get what you pay for. So on to the better accountants here I go. I really feel finding a good accountant will save me money in the long run. I am self employed so every little bit helps. And the less chunk I owe the IRS the better. I feel a bit more confident now. Thanks alot.

Your right to file for an extension has nothing to do with your bankruptcy. The purpose of the extension is to give you more time to fill out the form, not more time to pay the tax. So don't forget that you must pay the tax you estimate to be due with the extension request or face penalties. Penalties could lead to a complaint that you're not fulfilling the plan.
