Filing without spouse


What is the name of your state? NE

I have a lot of credit card debt and am unable to keep paying it. I am married but all of these are in my name only, my husband did not even know that I had them. Will I be able to file on these without involving him? The house that we have is in his name only and he purchased it before we were married. We have a home equity loan on it which I co-signed on. My vehicle still has a balance and is in his name with me listed as a co-signer. Otherwise we have no other debts together.

You can certainly file without him, but you're not going to be able to keep it a secret when you have joint and co-signed accounts. What you have discharged will become his sole responsibility on the joint debts. You can choose to reaffirm on the co-signed loan.

Sorry, one more question please. I only want to file on the credit cards which are not in his name. The house and car loans are up to date because he pays those. Is this possible? Thank you,

You're required to disclose all of your creditors.
