Foreclosure or Deed in Lieu and assests


What is the name of your state? FL

Thanks to all of you for previous input to my questions

BK was discharged in 9/03 and house not reaffirmed. Last payment on house was 4/04 and letter received from bank in July 04 of foreclosure proceedings. Received letter from bank stating they would consider a deed in lieu and sent an affidavit for me to complete of debts and assets which I completed and returned. That was about a month ago and I have heard nothing from them. Here is the question. At the time I filled out the affidavit I did not have a car that was not financed. My daughter is wanting to pay my car off for me but I need to know if that would affect anything with the foreclosure or deed. I assume if they decide not to accept the deed then they would go ahead with foreclsoure and with that the bankruptcy discharge would just kick into place and my owning a car free and clear would not be an issue. What should I do?

Next question is at this point is the house considered still mine or is it already the property of the bank? Thanks again for any answers.

Does anyone have an opinion for me. My daughter wants to send in the money to pay off my car but I don't know if it will hurt my Deed in Lieu should the bank decide to accept. Could it hurt the foreclosure if they went forward with foreclosure?

If I were you, I'd wait until you hear from the bank on the deed in lieu before your daughter pays off your car. I don't think it would be in danger anyway, but its better to err on the side of caution.
