Former bankruptcy questionWhat is the name of your state? Alabama We filed chapter 7 bankruptcy in 2003. We did not reaffirm our home so we are still getting monthly statements from the bankruptcy dept of our mortgage company. We have recently had a large payroll taxes mortgage lien placed on our house by the IRS from a former business that my husband had. We have set up monthly payments with them - but the lein is on our home already. Since we never reaffirmed our house - if we walk away from our house now and let it go with the bankruptcy - Will the house be sold by the mortgage company and will the IRS lien have to be paid off first? In other words - if we walk away from our house will our IRS lien be paid off by our mortgage company before they get any other sale proceeds? |
