Furniture Delivery, Company Bankrupt Sorry in advance if this is the incorrect forum for this article but here goes: What is the name of your state? New Jersey. Purchased furniture from a company in Carolina Approximately 12 weeks ago. They charged Credit Card 50% at time of order and 50% when the furniture arrived at store. Company called last Thursday to collect the remaining 50% (charged to credit card) as the furniture had arrived in the store. Today we receive a call from someone at a third party delivery service stating we would have to give them $200.00 to cover the cost of delivery since they could not collect from the now bankrupt company we purchased from. The person went on to say that if we did not pay the deivery charge the furniture would be auctioned off. When we placed the order all delivery charges were included in the purchase price. My questions are: 1) are we responsible for paying the delivery charge. 2) If we refuse the order because the company did not honor the existing sales order/agreement will we receive the funds back from the Credit Card Company if we dispute the transaction? and 3) If the delivery company delivers even after we have refused to pay the furniture companies supposed obligation to them what is our recourse if the furniture is damaged. |
