garnishment just before bankruptcy


What is the name of your state? Kansas my husband and i have decided to file bankruptcy due to a BAD court loss, we have only just begun talking to a bankruptcy lawyer and today I receive an order to garnish my wages. I am going to file a reply, but what point will we have to get to in filing the bankruptcy for the garnishment to be stopped. ie: will they be able to garnish all the way up until the bankruptcy is approved by the courts? Thank you.

The Automatic Stay goes into place as soon as you file your papers with the BK court and are assigned a case number. IF they garnish before you get that far, the monies will have to be returned to you.
