garnishment just before bankruptcyWhat is the name of your state? Kansas my husband and i have decided to file bankruptcy due to a BAD court loss, we have only just begun talking to a bankruptcy lawyer and today I receive an order to garnish my wages. I am going to file a reply, but what point will we have to get to in filing the bankruptcy for the garnishment to be stopped. ie: will they be able to garnish all the way up until the bankruptcy is approved by the courts? | The Automatic Stay goes into place as soon as you file your papers with the BK court and are assigned a case number. IF they garnish before you get that far, the monies will have to be returned to you.
