Getting Divorced and Filing Ch. 7


What is the name of your state? CO

Wife and I are getting divorced and are also filing ch. 7 but we want to file bankruptcy jointly so do we have to be discharged or just filed before we can finalize the divorce?

We did this also, filed chapter 7 Bankruptcy joint still married, divorced before the 341, then discharge. Went well for us, trustee only asked where you married at the time of filing. I would only do this with 100% trust with your future X. They could cost you a discharge if they don’t comply. Good luck.

Talk to a lawyer. Divorces can be held up by bankruptcies and vice versa because of division of assets issues.
