gift certificate hassel


What is the name of your state? Minnesota

I purchased a $30.00 gift certificate from a restaurant whose owner filed bankruptcy a month latter (Unknown to me at that time). The cert. was for my daughter. Several months later she went to the same restaurent for dinner, they would not accept the cert. Apparently the creditor resold the restaurent to another party who would not honor the certificates. The restaurant did not change location or name. They even ran newspaper ads stating they they have "been established in the area for 54 years"
I took them to concillation court and won. They got an attorney and are appealing to district court. Is there some responsibility to the public when a business retains its name and "pretends" nothing happened?.Do I have a chance in district court handling it myself? Bud

Sounds like you definitely got a case since they're retaining name/ownership. Keep us posted on the outcome.

I can't believe they're going thru the expense of an appeal for a lousy $30 gift cert !!! Geez......

WOW!!!! Took the word right out of my mouth Ladynred. Who hires a lawyer for $30???
Do you have a consumer affairs reporter on your local TV station or, newspaper? If so, I think I'd give 'em a call. This guy needs some free publicity.

Gift Certificate


The restaurant owner called me a couple weeks after the Appeal Notice came. He said the reason he had to appeal was that by leaving the win in Conciliation Court he would be liable to honor any other outstanding gift certificates, of which apparently there were alot.

As far as getting the media involved, I had thought about it but don't want to subject myself to any possible counter lawsuits by him. Does anybody know of any Statutes or pressidents I could use when I represent myself in District Court. My Court date is December 19th.
