Question

I have an auto loan with a bank. for 2 years they have harassed us stating that we have not paid on certain months. I have sent them proof i.e. cancelled checks; I have tried talking to many people in many departments. I have filed a BBS complaint on them to no avail. I found out in May that this bank has reported on my credit as being 30, 60, 90 days late for at least 8 months in the past 2 years. I am at a loss. Do I have any legal right to sue this bank for their continuous harassment? By the way, they have changed hands 3 times since we got the original loan-could this be the problem? Please advise..

Can you sue them?? Yes, anyone can sue anyone else, with or without merit.

First, you either will have to have a lot of money (for lawyer fees) or will have to find a contingency lawyer (not likely).

So, now to the 'real world' ----
Write a dispute letter to the Credit Reporting Agency (CRA), send it certified and keep a copy. Advise the CRA that the payments were not late and that you have requested the reporting merchant to correct their request without success (you might include proof of ontime payment if any). The CRA is required (by the FCRA - Fair Credit Reporting Act) to investigate and remove any unproven negative comments.
