HELP ASAP!!!! 341 meetingWhat is the name of your state? ms just got back from 341 meeting. everything went ok except for one creditor, a finance company. he asked me if i wanted to reaffirm my loan and i said everything no, that everything i put down as collateral was personal property and exempt. he said ok and sat down. trustee said you are dismissed. then the guy from the finance company caught me on the way out and said that he was going to petition my exempt property. i put down as collateral 4 tv's and 2 computers. Was i right or did i screw up?????????? need help asap cuz if i am wrong then i need to contact this finance company before he does petition and work something out with them. maybe i misunderstood the exemptions for the state of ms but thought they had a wildcard and you could put down any personal property up to $10,000. HELP ME PLEASE!!!!!!!!!!!!!!!!!!!! ![]() |

| The creditor is full of it. The 10K exemption (wow !) should cover everything and then some. The guy can petition all he wants, its up the Trustee to allow or disallow it.. and for 4 tv's and 2 computers.. he probably won't. How old are the tv's and pc's and who was the creditor ?

| the creditor was Republic Finance. When the trustee asked if there were any creditors he stood up, stated his name, and asked me if I wanted to reaffirm. I said no. He asked me if i still had the tv's and the computers and I said yes. Then he said okay and sat down. Then the trustee said I was dismissed. As I was walking out the guy from Republic Finance said he was going to petition my exempt property, that I was only allowed 1 tv. I told him that I had a wildcard exemption (hopefully I was right for the state of Missisippi) and that personal exemption for Mississippi was $10,000. I said it doesn't matter if i have 1 tv or 5 tv's, they were exempt. I told him to do whatever he wanted to do and I just walked away. I've had the tv's for at least 8 yrs and the computers for 3 yrs. So was I wrong or right???????????? Also, the Sears guy was there. He left and was not there when they called my name. I had $4000 on their card. Guess he had his chance and missed it. RIGHT!!! Can they still dispute my debt? Last edited by rammbh; 06-12-2003 at 02:53 PM. |

| You're correct on the amount of the exemption, it is 10K for ANY personal property. Just goes to show how much the guy from the finance company knows.. lol. 8 years for a tv is a LONG time and they aren't worth much of anything either. Same goes, even more so for the computers. A 3 yr old pc is OBSOLETE and probably worth only a couple hundred $$ if that. None of those together would come anywhere NEAR $4k ! I'd be willing to bet his petition, if he has the guts to file one, gets denied.
