Question

I owe money on a credit card and did not pay regularly, due to personal reasons. Mainly that I do not work, have two children, and my husband is the only one working. We tried our best but our best wasn't good enough.

We have now been put into a collection agency. I contacted them and tried to make arrangements with what I can pay. They turned me down on my offer or put a condition I just can not meet. I'm having trouble paying 100 dollars a month and they want me to come up with 650.00 for them to even consider the 100 per month. I am trying to make an arrangement. I want to get out of debt. I want to pay these people but how can I give them what I don't have.

They then threatened to take me to court where they would ask that my husband's check be garnished. We're barely making it now just living check to check. I need some advice.

Is there anything I can do?

First, you need to be aware that a collection agency can't sue you, only the original creditor (in this case the credit card company) can file an action. And if they get a judgment, then there is a long process that they need to go through to do a garnishment. The threat of legal action or garnishment by the collection agency is illegal (read the FDCPA at [url="http://www.ftc.gov)"]http://www.ftc.gov)[/url]

And since you didn't read the instruction at the top of the page (those little words in red), we don't know where you are, so can't tell you whether garnishment of wages is even allowed in your state.

As to what to do, call the collection agencies bluff.
