help I got nothing for themWhat is the name of your state? NY My ex-univ from past 5 years now sued me for debt of $20k+, in tuition, not loan. Which I did not graduate from nor attend more than a few weeks (withdrawn without notice due to long story dispute). Tuition charging for about 1 1/2 year of fee. But I need legal advice...on what could happen to me. I can't pay. I have practically nothing. I rent. My salary is $750 a month, and I paid $400 for rent, and could barely have enough for food. The Collector told me I need to pay at least $150 a month...which is impossible for me. No one can help me financially. I am foreigner who's visa has expired. What's the worse can come to me if I ignore this? I only have like $100 in my bank account will i lose that? I don't have much in my rented apt, will I lose them? imprisonment? cellphone account? etc. I am trying to create a business account to try to boost my income however that would be...would creating such account be a problem? | Can't get blood from a turnip, Tom. If they take you to court, they may get a judgment against you, which will hurt your credit something awful, and quite possibly make it impossible for you to rent in future or get insurance or lots of other things that don't seem to be related to your credit. Try going to CreditBoards.com and see what they tell you there. Those folks are EXPERTS at getting out of debts, both legitimate and erroneous. You didn't tell your whole story here, but if this is one of those cheesy for-profit continuation "colleges," they are known to be ruthless about collecting, so you may expect to end up in court. Don't NOT go. Show up and tell the judge your story. And check CreditBoards.com. They know what's up. |

JudgementHi ana, Sorry for being vague. And Thanks for responding. A judgement has been entered against me. What I would like to know is if I can still file for bankruptcy. And what happens if I don't. Here's my status: I got nothing accept like computers and some personal items. My apt is rented. That's it! As far as my credit is concern. I really don't care, I'm not citizen, I'm not any resident. I'm foreigner whose student visa has expired. So my visa is not good anyway. I get paid by cash from work, but very little. Therefore I don't have enough even if I were to schedule payment. So, what else can they do to me? Please help. Thank you. Tom |

| What's the point of the BK then? If you've got nothing to lose (assets) and nothing to protect (credit), and you don't believe you really owe the debt, why bother? If they've already got a judgment against you, and there's nothing for them to collect against, as by garnishing your wages, they're pretty much out of options. Filing a BK would serve you no purpose. It's meant to protect a debtor, but there's nothing for you to protect, from the sounds of things. You'd just blow money on an attorney and fees. They have a dead end. Like I said. you can't get blood from a turnip. |

| Bankruptcy would do you no good - you're not a legal US citizen and you already said you are not resident - though clearly you are because you do live here - albeit illegally. However, like Ana said, you have nothing they can take from you, not even for a wage garnishment (you don't make enough and you're paid under the table).
