Help Me With Not Knowing My Bk Rghts


[SIZE=4]HELP ME WITH MY BK RIGHTS[/SIZE] calif. i filed chapter 13 in2000, my original attorney went ot of practice in my town. it was 6 months before i found out i had another attorney, sinc then i have got in the rears on my house payment, and chaptr 13 payment. we went to court two weeks ago, got an extention, modification. i have creditors on my claim that i do not know where they came from. every time i ask my attorney, he says he will check into it. never happens. he made a promise to my mortgage company for rears payment o top of regular payment. i was told by a employee of my lender that my april 2002 payment was being sent back to me due to my lender foreclosing on me. two days later i recieved a letter stating my lender wanted relief of stay. i have not been clearly informed of my chapter 13 rights by either attorney. what ca i due. ?.

Not trying to be funny...


.. but the term you need for your mortgage and Chapter 13 payments being delinquent is 'in arrears' not 'in the rears'

It sounds to me like you just need a new lawyer to handle your case. You could always call the local Bar Association and ask them what you can do about it. Sounds like your attorney doesn't have your interests in mind.

In the " Rears" right the first time


When he referred to being in arears of his house payments I thnik he ment getting it in the rears from his Attorny..they don't care they just want th e money!! Everybody makes sure they get thiers ****************************.

probably true.. but his statement was , "sinc then i have got in the rears on my house payment" .. hence my response. Not all lawyers are bad, but this guy DOES sound like he's been getting screwed by his. He needs to find a new one if possible.
