Question

How does Bankruptcy work for an inmate of a Federal Corrections Facility???


What is the name of your state?Texas

I was asked to find out how bankruptcy works for somone who was recently sentenced and serving time in a Federal Corrections Facilty. They were sentenced for 10 yrs. and needs to file Backruptcy for all debt.

All help is appriciated!

**A: the exact same way as somneone who is not incarcerated.

Except that the person filing is supposed to go to their 341 meeting IN PERSON, so I'm not sure how an inmate would be able to do that unless there's some allowance for it. At the very least, the lawyer for the inmate would have to file a motion to allow the inmate to appear at his/her 341 meeting via interrogatories. This IS doable, but you must file the Motion and get approval from the BK court/Trustee.

Actually, I suggest contacting the U.S. Trustee's office. There is a procedure for this, and it involves coordinating with the case trustee, the warden, and someone to administer the oath in person to the inmate.

Thanks Walter !! I figured there was something in place for inmates but I hadn't really dug much to find out what it was.
