My response:
In Chapter 13, all debts are paid down on a 5-year plan. That means, everyone gets a little something; i.e., usually pennies on the dollar, during that 5 years. At the end of 5 years, it's all over, and whatever you received from the BK Trustee is all you're going to get - - from the parents.
Go after the kid, if the Statute of Limitations hasn't run out yet. Of course, you can get a judgment, but if the kid has nothing, then all you'll get is a judgment that's good for 10 years, and renewable for another 10 years. In other words, forget about it.
