how long after 13 can you do a 7What is the name of your state? Calif My husband and I filed for chapt 13 many years ago. It was discharge as being paid in full in Sept 2001. In about 1999 we separated, though still not "divorced" have lived separate since then, taxes, living arrangements and our finances have been our own. He has had some credit card debt that is threating garnishment (and a few other obligations) Where I have no credit card debt but have a large medical bills (over 10K) under my belt and a few. We have no real assets and were considering filing Chapt 7. My only issue is there is a number of years you can't file after Chatp 13 and I am not sure if it when we first filed chapt 13 or after the discharge. If it is the discharge I am not sure we are eligable, or if I am actually responsible for his charges. I hope that makes some type of sense.What is the name of your state? |

| Under the new law, you must wait at least 4 years to file a Ch 7 after a discharged 13. If your Ch 13 was discharged in 2001, you can file a Ch 7 now.
