Aprroximately 4 years ago I had a Chapter 7 discharged, and now I'm considering a Chapter 13, is that possible? I had lost my job about 2 months ago, I immediately got another job, but I'm making about $1,000.00 less take a home a month, that is why I am considering a Chapter 13. I am one month behind on my house and car, I also have lots of medical bills for my son and credit cards I haven't been able to keep up on. Please Help!!

My response:

No. You can only discharge your debts every 6 years. Go to a Credit Counselor (Free) and have them negotiate smaller monthly payments for you.

I was under the impression that Chapter 13 was re-organization, there are no discharge of debts, you repay them monthly to the trustee, is there a new law recently that changed this, I use to work in the finance business and I saw a lot of people file Chapter 7 and then a few years later file Chapter 13, and vice versa, could this maybe be a California Law?
