IRS Taxes, Penaltys, Interest - Dischargable or Not?What is the name of your state? Florida I owned an insurance agency and wasn't making enough to pay my bills and pay my taxes. I didn't file from 1992 to 1997 - then I filed all six years in 1997. Through a former IRS agent, I was able to keep them off my back until now. They have put a lein against my property. I don't have any, so that doesn't matter much. They levied my wages and left me with $425 every two weeks. I negotiated with them and the levy is supposed to be dropped if I start making payments. I've met with one attorney who thinks that he can get these discharged. I've called two other attorneys who say the taxes aren't dischargable. Even the attorney that I'm met with gave me a handout that said, "most taxes aren't dischargable". Anyone know if they are or aren't? Thanks, Tim |

| Under some circumstances, back taxes may be discharged. [url]http://www.taxhelpers.com/tax-collections-1.html[/url] Generally, all income taxes, both Federal and State taxes may be discharged if they are old enough. In the case of the income taxes, they are dischargeable in Chapter 7 if all of the following criteria are met. The tax is for a year for which a tax return is due more than 3 years prior to the filing of the bankruptcy petition; A tax return was filed more than two years prior to the filing of the bankruptcy petition; The tax was assessed more than 240 days prior to filing of the bankruptcy petition; The tax was not due to a fraudulent tax return, nor did the taxpayer attempt to evade or defeat the tax; The tax was not assessable at the time of the filing of the bankruptcy petition; and The tax was unsecured |
