Jointly Owned Property Involved in Single Debtor BankruptcyWhat is the name of your state? OKLAHOMA Can someone answer this question for me? I found out from a credit report that I obtained after being turned down by a credit card company, that my ex-husband, 1 year after our divorce filed for bankruptcy and the house that we still jointly own was listed in the bankruptcy and now appears on my credit report. Should I have been notified at the time of his filing that he was filing, since I also own the property. The deed is listed as Mr and Mrs, not or. I know that I can challenge the information listed on the credit report, but I just wanted to know how come I wasn't notified like all his creditors were. Is that legal? |

| Unless your ex had included you as a creditor, there's no reason you would be notified that he was filing for BK. If he hadn't reaffirmed on the house, then the lender would have most certainly come after you for the payments and you'd certainly have known then. Aside from that, there's no obligation to notify you at all. You can dispute bk on your CR, since it was not YOU who filed.
