judgement


What is the name of your state?tn
yes, bigon it was included in the b/k they, the attornies are saying because the judgement was placed on the property before the b/k it is still active and we owe the money. cant get the attorney that we used to return our calls. any advice would be appreciated. thank you.

How are you being contacted/ Have they sent a letter demanding payment?

no they haven't send a letter. our daughter is a paralegal for real estate attornies and she looked up our deed for us and it showed that the judgement was still on there. that prompted me to call the attorneys that had put the lein on it from ford motor . they said that because the judgement was on before we filed b/k that it was still active and due. we have never gotten any kinds of mail from them to date.

OK, you need to find a lawyer and see about getting the lein removed. They're wrong that the money is due and that's why they've not tried to garnish or freeze your bank account ,etc. But, you'll need to get the lein released before you can refi.

after posting to you this morning i called the attorney that had respresented us and re would not talk to me. through his secretary he relayed the message that he would not help us any further. i have been trying to find one in our area and not having any luck, but will keep on trying. thank you so much for you info, it has raised our hopes that we can sell.
