Ladynred, Which Nolo book to avoid lien?


What is the name of your state? TX

Ladynred, which Nolo book did you get the info on Eliminating Nonpossessory Nonpurchase-Money Security Interests from?

As I read through this, they are talking about lined legal paper (forms included in book) that I can probably re-create, but also preparing a proposed Order to Avoid Nonpossessory, Nonpurchase-Money Security Interest for the judge to sign, preparing a Notice of Motion AND Proofs of Service by Mail !?!?! (which have to be mailed by someone who is not a party to the bankruptcy - WHAT?)

Anyway... I hate to keep bugging you to send me e-mails (unless you REALLLLLY don't mind) but I'm going to need to see this stuff and hope I can find the book at the library to get this done.

Nolo Press - "How to File For Chapter 7 Bankruptcy"

the 'lined' legal format is really nothing more than having every line of text numbered, and its either double or triple spaced.


I found a handy template somewhere on the web once, I'll see if I can dig it up.

But what if it's a car?


I understand the avoid lien circumstances, and I have the Nolo book. But I cannot find if you can do this if the loan involved a vechicle ? (It was non-purchase loan,and the vehicle is exempt)
Everything fits except the Nolo does not say "vehicle".

If the loan that is secured by the vehicle is not FOR that vehcile, making it a secured loan, then the nonpossessory nonpurchase security interest should be the same (someone correct me if that's wrong).

What are the circumstances behind the car securing the debt ??
