TX and married
we are about to start bk and I have property in my name and the house is in my husbands. My father wanted me to keep the property even if we lost the house (mobile home). The mortgage company wants the house back. If we file 13 or 7 is there any way to keep the property?
The property is valued (tax roles without house) $3,800.

You need to consult with a lawyer about exemptions under Texas law. Don't try and do this yourself.

We are going on Wen. to a lawyer. I saw something where you can sell the property 90 before filling (but sounds like that is risky and can be over turned). That would be information good to have before I go.
I also was reading a new bill being passed by the senate

NCLC Reports Nov./Dec. 1999 and Jan./Feb.2000 NCLC reports,
Bankruptcy and Foreclosures Edition
That says something about homested exemptions under a certain amount. I will be asking this question to the lawyer.

Does any one know what else I need to ask about?
