Question

Is this legal?


What is the name of your state (only U.S. law)? MO
I filed chapter 7 bankruptcy and was discharged, a rental property was part of this bankruptcy and the mortgage co. will not take it back or foreclose and their reasoning for this is they dont want to be liable for the taxes,insurance and keep up on the property. They told me i was responsable for the taxes and etc..and they would just put a lien on it..My question is can they legally do this when this property was part of the bankruptcy?

Interesting situation. I don't believe there is any way they can be forced to take possession of the property so, yes, it is legal. If I were you, and I wanted the property out of my name, I'd look into possible repercussions of not paying the taxes and having it sold in a tax sale. Someone with experience in MO real property laws might be able to help you more.
