| Lein on current home. What is the name of your state? CO
I filed bankruptcy in December of 2000; a creditor had filed a judgment in December of 2000. My Bankruptcy was discharged in April of 2001. The creditor had filed a lien against my property; however I had surrendered my house in the bankruptcy. In April of 2003 I purchased a new home, and this year I went to refinance my home and the creditor has a lien on my current property. The title company that I am working with sent them my bankruptcy papers with the discharge however they refused to take there name off of my title. I then contacted my attorney that did the bankruptcy and he said he could reopen the bankruptcy and that would cost me around $500.00. He did not sound all that helpful. I also asked him if I could recoup the money I send from the creditor. He said possibly. This is not good enough for me. How could a creditor do this and why would they not be responsible for the money I have to spend? Is there any other course of action I could take? Is this legal? |
