lein on property after bankruptcy


What is the name of your state? Illinois

In 2002 I was being sued for collection of debts on a credit card I couldn't pay so I declared bankruptcy. My lawyer at the time told me not to worry about the collection suit and he would take care of it. I recently found out the collection suit proceded and a judgement was entered against me a week before the debt was discharged in my bankruptcy.

Two years later I inherited a piece of land and last year I purchased a house.

I tried to sell the land recently but as a result of this judgement my home and the land have liens against them that I need to get removed. I took proof that the debt had been discharged to the courthouse but the only thing they would tell me is go back to my bankruptcy lawyer (who is no longer around).

Fortunatly the title company accepted the proof the debt had been discharged and handled the lein against the land but I still have a lien against my home.

Is there any way to get this lein removed and make sure it won't attach to any future property I own without paying for another lawyer?

You need a lawyer to get this done correctly. The code does allow for lein stripping plus, the creditor violated the automatic stay by getting a judgment during the bk process.
