At a loss


What is the name of your state? Indiana
My husband was in an auto accident. He ran a red light and was t-boned and then hit another vehicle. All three vehicles were totaled. He let his insurance lapse in December. He figures there is about $30,000 in damages (not including any medical if there will be any). My questions relate to what I can do regarding the situation to protect myself (by the way, I am insured). I live paycheck to paycheck as many americans do. I have no savings. I am trying to raise my infant daughter and this situation is freaking me out. We (he) owns a home. It's not much but we have about $25.000 in equity in the house. It is in his name only. If he gets sued, can they take the house? If I divorce him (not just because of this, it was coming) and I am wondering what happens to the house then. Also, can they go after me for any assets I acquired prior to the marriage? If he gave me the house in a divorce settlement would the house be protected? I know I sound selfish but I worry about myself and my child and nothing else. I have worked very hard to get the equity we have in the house and it is half mine. I don't want to lose it. Can you suggest anything?
