What is the name of your state? IN
My husband and I are currently in the process of filing a Ch. 7 bankruptcy. We are filing pro se. I have researched and researched and understand most concepts, etc. that are involved. We are also using Ziinet. There are a few things that I have been unable to find the information for. Any help would be GREATLY appreciated.
My husband has custody of his 2 children from a previous relationship. The ex was ordered to pay child support several years ago, but it's like pulling teeth to get her to pay. She is currently in arrearage of around $8k to $9k.
Now, I thought that I had read somewhere that we have to list the arrearage as an asset, but that it is exempt?? Is this correct? If so, where would I list the arrearage and under what law is it exempt? I have read, read, and reread the exemptions for IN but cannot for the life of me figure out which one child support arrearage would fall under.
