A lot of questions and no answers


What is the name of your state? Tx

My husband and I am presently in a Chapter 13. My house is involved because we got behind on the notes. The house is in my name only. The back payments on the house have been caught up now through the Bankruptcy. We are now paying on unsecured debt.

My question: I want to leave my husband, change to Chapter7 and let the house go back because I don't have the money for an attorney and don't want to go through any changes with my husband about the house, so I would rather give it back. If I give the house back through the Ch.7 will this go against my credit as a repo?

What did your BK attorney tell you when you asked him?I thought you didn't like the answers you received here.

I never said that, that was your perception of my response. Some folk gave me answers to my questions instead of answers to what I didn't ask for.

This is what I object too, we come in here with serious questions (to us) and we get a bunch of smart mouth reponses instead of a simple answer. Does it make you feel good about yourself when you slam us?

Your credit will be destroyed regardless of how the mortgage reports. A dismissed Chapter 13 and a brand new Chapter 7 will be killers. If the mortgage company begins foreclosure prior to your filing it's very likely that's how it'll be reported.

In my present BK my past due house payments are paid up and we pay monthly house payments outside of the Bk, which are also up to date. We have caught up all secured debts and are now paying on unsecured debts. What will happen concerning the house if I just stop paying the BK - can I keep the house (with it being caught up)? I'm just trying to find the best route to take and not mess my life totally up as far as credit.

Well, you can't keep the house w/o making the payments. Your better option would be to leave the husband and see if you can CONVERT to an individual Ch 7 rather than having the 13 dimissed and having to re-file.
